The Common Expat Surprise

One of the most frequent surprises for expatriate workers leaving jobs in Dubai, Abu Dhabi, and the Northern Emirates is discovering that their End of Service Gratuity is significantly lower than their total monthly take-home pay suggests.

If your total compensation is AED 25,000 per month, but your contract specifies a Basic Salary of AED 15,000 alongside AED 10,000 in housing and transport allowances, your gratuity is calculated strictly on the AED 15,000 basic wage.

Why does the law make this distinction? What items qualify as allowances, and what does the official MOHRE contract state?

Article 1 of the UAE Labour Law provides precise statutory definitions that govern payroll and terminal benefits:

1. Basic Wage (الراتب الأساسي):

"The wage stipulated in the employment contract, which is paid to the worker in consideration of his work under the employment contract, on a monthly, weekly, daily, hourly or piecework basis, without any allowances, bonuses, benefits or other remuneration."

2. Gross Total Wage (الأجر الإجمالي):

"The basic wage plus all allowances, bonuses, commissions, benefits in kind and any other entitlements granted to the worker in return for his work."

Why Gratuity Excludes Allowances (Article 51 Clause 2)

Article 51(2) explicitly commands:

"The end of service gratuity for foreign workers shall be calculated based on the worker’s last basic wage."

By explicitly tethering gratuity to the basic wage, the law ensures predictable, defined obligations for employers while enabling flexible compensation packages tailored to the UAE's high-cost living dynamics.

Items Strictly Excluded From Gratuity:

  • Housing / Accommodation Allowance
  • Transportation / Vehicle Allowance
  • Fuel and Travel Stipends
  • Annual Airfare Ticket Allowances
  • Mobile / Telecommunication Allowances
  • Discretionary Performance Bonuses
  • Schooling / Education Fees
  • Overtime Wages

The Typical 60/40 Salary Structure in the UAE

In the UAE commercial sector, employers commonly structure executive and white-collar compensation using a 60% Basic / 40% Allowance split (e.g., 60% basic, 25% housing, 15% transportation).

Why Do Employers Prefer This Split?

  1. Lower Terminal Liabilities: Gratuity accrual is directly proportional to basic wage. A lower basic component substantially moderates the firm's long-term end-of-service liability.
  2. Flexible Benefit Structures: Allowances can be adjusted or linked to specific local living circumstances without fundamentally restructuring the core contractual base wage.

Can an Employer Artificially Deflate Basic Salary?

While the law allows parties to negotiate wage breakdowns freely, UAE labor courts have historically scrutinized extreme or abusive imbalances.

If an employer drafts a contract allocating AED 1,000 as basic salary and AED 19,000 as allowances solely to evade statutory severance obligations, the Ministry of Human Resources and Emiratisation (MOHRE) and labor courts have the legal authority to reclassify allowances as part of the substantive basic wage if the allowances are deemed artificial or fictitious.

What Gratuity Uses vs. What Leave Pay Uses

To avoid confusion when reviewing your final settlement statement, keep this critical comparison in mind:
